QUESTION from the audience at PBS NewsHour Presents: the Plastic Problem Panel Discussion

Have you encountered any federal or state legislation that makes a single-use plastic ban more difficult? i.e. regulations that require plastic wrapping for health and safety reasons but might in fact be outdated or unnecessary?


ANSWER
There are currently 14 states within the US with some form of statewide legislation preventing municipalities within the state from adopting local bans of single-use plastics. This type of statewide legislation is known as a preemption ban.
